1. The purchased Products will be delivered by express courier or professional transporter, to the address indicated by the Customer as the destination address or, if indicated, it will be possible to collect and pay for the material at the DRAKE headquarters of  Bertipaglia Enrico, located in Viale Montesi 13 – 35025 Cartura (PD).

2. Delivery is considered to have been made from the moment the Product is delivered to the Customer: the delivery document issued by the carrier, dated and signed by the Customer upon delivery of the Product, will constitute material proof of transport and release of the goods. Therefore, upon delivery, DRAKE di Bertipaglia Enrico recommends that the customer check the condition of the products and the number of packages delivered before signing the transport document.

3. Please check the package carefully and in case of any problems accept the delivery only with "Specific Reserve" and specify the damage in detail. In case of obvious discrepancies, we ask you not to accept the goods and send them back. At the same time, please inform us by email at info@drakekart.com

4. The customer becomes responsible for the risk of loss of the goods starting from the moment of delivery (art. 63 Consumer Code).

5. Product deliveries are processed within 24/48 hours (except for customized or unavailable products). The shipping terms indicated on the Site must be considered non-binding for DRAKE di Bertipaglia Enrico, which can subsequently confirm or modify them, depending on its actual possibilities and needs. 

6. Delivery times are indicative if there are no physical or structural impediments (e.g. incorrect addresses) or force majeure events such as strikes, natural disasters, problems relating to transport/ supply/manufacturing. Delivery times are always expressed in working days.

7. Unless otherwise specified, delivery of products is always intended to be at street level.

8. The cost of shipping to Italy in express mode will start at 5.99 EURO, which will automatically vary on your cart, based on the volume of the goods developed. Once the threshold of 49 EURO for Italy and 99 EURO for Europe has been exceeded, each shipment will be totally FREE.

9. The cost of shipping to Europe can be done in economy mode (48/72 hours) or express (24 hours). The cost of shipping varies from the European area and the service; it will start from a minimum of 9.99 EURO and for European areas it will be free after spending 99 EURO with the Economy service. The Express service for Europe will always be paid. The final cost will be displayed in the electronic cart before proceeding with the payment.

10. Delivery to the rest of the world will take place within 24/48/72 hours from the moment the material is handed over to our courier. The cost of shipping varies depending on the destination area, and starts from a minimum of 21.99 EURO. Our electronic shopping cart will allow you to have a definitive cost of shipping, before proceeding with the payment. For shipments outside the European community, you will have to pay customs duties, which will be calculated at the time of delivery of the package and which cannot be estimated in advance. For shipments outside the European community, and of large dimensions, the courier will calculate a standard shipping price. It may be that in some cases we are able to have more advantageous rates, therefore we ask the customer to contact us by email, indicating the items that we wish to purchase and where they should be delivered, so that we can make a correct shipping estimate, given the volume of the package.

COLLECTION OF PRODUCTS IN CASE OF CUSTOMER ABSENCE

1. In the event of the recipient's absence during delivery, the carrier will leave a notice of passage at the delivery address indicated by the Customer. In the event of the recipient's absence even in a possible second delivery attempt, the Products must be collected at the address and according to the methods indicated by the carrier.

2. In case of failure to collect within the deadline established by the carrier, the Products will be returned to DRAKE di Bertipaglia Enrico, which reserves the right to refund the price of the Products, leaving the shipping costs to be paid by the customer. In the event that the carrier should charge additional costs (storage, opening of dossier, etc.), DRAKE di Bertipaglia Enrico will charge the customer.

PRODUCT AVAILABILITY

1. DRAKE di Bertipaglia Enrico ensures the regular fulfillment of the order placed, reserving the right to order the goods temporarily not available from the suppliers and undertaking to inform the Customer as soon as possible and to specify a deadline for the availability of the Product. 

2. The Customer may in any case inform DRAKE di Bertipaglia Enrico if he intends to wait for the product to be available or to avail himself of the right to request a refund.

3. Products not available in stock can also be regularly ordered and paid for and therefore delivery will take place in 8/10 working days. The site will indicate the available and unavailable products during the order phase.

RIGHT OF WITHDRAWAL

1. The Customer has the right to withdraw from any distance contract, without any penalty and without specifying the reason, within 14 working days from the day of delivery to the consumer. 

2. The right of withdrawal must be exercised by the Customer, under penalty of forfeiture, by sending an email.

3. The right of withdrawal cannot be exercised for "goods made to measure or clearly personalized".

4. All returns (which must be perfectly intact and accompanied by the original packaging) must be authorized by DRAKE di Bertipaglia Enrico. The product must be returned in its original packaging. It must not have been used, nor have suffered even minimal damage, in a perfectly clean state and in resalable conditions. Once the return has been authorized, the Customer can return the Product to the following address: DRAKE DI BERTIPAGLIA ENRICO - Viale Montesi, 13 - 35025 Cartura (PD) Italy. Cash on delivery packages will not be accepted.

5. Once the Products have been received (and their integrity has been verified), DRAKE di Bertipaglia Enrico will attempt, as soon as possible, within a maximum of 14 days, to refund the Customer the sums paid.

6. The return costs are entirely borne by the customer. Following receipt, DRAKE di Bertipaglia Enrico will examine the goods to verify the existence of any damage or tampering, total integrity is an essential condition for exercising the right of withdrawal. In the event of damage during transport of the returned goods, DRAKE di Bertipaglia Enrico will notify the Customer of the incident within 5 working days to allow him to promptly file a complaint against the courier chosen by him and obtain reimbursement of the value of the goods if insured; in this eventuality, the Product will be made available to the Customer for its return, simultaneously canceling the request for withdrawal. DRAKE di Bertipaglia Enrico is not liable in any way for damage or theft and loss of goods returned with uninsured shipments.

7. All shipping and packaging costs for the return of the goods are the responsibility of the Customer (pursuant to art. 67 paragraph 3 of Legislative Decree no. 206 of 06/09/05), except in the case of non-conformity or hidden defects of the Product.

COMPLAINTS

1. Complaints for non-compliance of the products delivered with the order must be sent in writing by email, immediately after receipt. In the event of an error relating to the Product, the Customer undertakes to return said Product or the Products concerned to DRAKE di Bertipaglia Enrico within 7 days of receipt, provided that they are returned with the packaging closed, in their original condition and packaging with the accompanying documents.

2. Once the product has been received in the correct form and manner, DRAKE di Bertipaglia Enrico will resend, at its own expense, the Product initially ordered as quickly as possible.
